PERSONAL ANALYSIS

I chose the topic about studying abroad because I believed it had a lot of content. Also, I wanted to express my point of view about studying abroad with the hope that my audience would agree with all or just part of the whole speech.
My introduction was effective. Mostly because I started off with a captivating topic sentence about the importance of joining higher institutions of learning. This would prepare the audience to hear more on the importance and easily agree with me on my topic about studying abroad. To establish credibility, I stated the important facts and also the advantages of having to study abroad.
By and large, I feel that my persuasive speech wasn’t the best. I feel that I should have been more organized and prepared so as to deliver the best and be in a position to persuade the audience. Though I was able to get the attention of the audience I could not sustain it although the speech.
In the conclusion I brought in positive energy, I projected my voice and used gestures. I also summarized the whole speech into one sentence which has the whole importance and purpose of the whole speech.
Though not fully, I managed to persuade my listeners to concur with me. During the speech, I observed that they were nodding in agreement and at times they even clapped. This is a clear indication that they were in agreement. My motivational appeals were effective mostly the logos appeal. Giving numbers and facts went along way in giving my audience tangible comparison to the facts given. I also used information that is at the disposal of almost everyone in order to set the foundation of the speech.
The rational appeals also went a long way in persuading my audience. I employed an approach known as convincing proof to help persuade my listeners. I gave an illustration of great leaders who went studying abroad and ended up being very useful and important people in their respective societies. Also, I used the second approach which is listing the benefits of a product or service. After listing and briefly explaining the importance of studying abroad, I could see the audience nodding in agreement. This approach mainly highlighted the benefits of studying abroad by the society and the individual student.
I never had any foreign citation the speech, but I had a specific outcome for the audience. I wanted them to concur with me under whatever costs. By using situational manipulation, I limited their options to almost none and had them to only agree with me. If I had the chance to do the speech all over again, I wouldn’t change the purpose of the speech I would only do more intensive research on the topic and work more on my delivering techniques. In contrast to my other speeches, this one was average and more manipulative.
In this speech, it wasn’t very dynamic though I decide to use cause and effect since cause and effect speeches are easier to write. This is because they show how something positive or negative can happen if you do something. So long as I had enough creditable sources, I really never had to do a lot of persuading since the truth is in the pudding.
People are usually more receptacle to what the speaker has to say in this case me. And inherently tend to incline lean to the positive side of the cause and effect technique. I have improved on my delivery techniques in the course of the semester by preparing well before hand and employing more use of gestures and more rational and emotional appeals. Also, I have included all the three emotional appeals in my speech, ethos, pathos and logos so that I can be able to at least appeal to all types of audiences. I have also been over the stage fright. This problem is now long gone.
My main strengths in the speech were the proper employment and use of the rational, emotional and motivational appeals, some of my weaknesses were in the delivery and organization of the speech.
The main areas that need improvement are on delivery; I need to be more composed and impose credibility to the audience that I know whatever I am saying. Also, organization is another point of concern, beforehand preparation of the speech will help boost my composure. I also have plans in motion to work on my ordering criterion. The order will help in the nice flow of the speech. Researching on the content is what I also take will advantage of. Rigorous research and brainstorming will go a long way in content development.

Illinois
Requisite questions that concern the requirement of a person who can be a witness, the presence of the opportunity, or the or the admissibility of the proof shall be determined by the court. The court is not bound by the rules of evidence while making its determination only those that concerns rights of the defendant.

New York
In the state of new York, for evidence to be admissible, it has to be voluntarily given by the defendant. Thus any evidence from the defendant, that may be obtained by violation of rights, promise, physical force, or by threat is not by any chance admissible.

California
The judge has the final say in the admissibility of a statement. The legal environs of the acquisition of statements that may be admissible in a law court are complex due to the restrictions in the California Code of Evidence.

There are some similarities when reviewing the legal requirements. In all states, the evidence provided is admissible as long as it is provided by the defendant voluntarily and was not forced or coerced. The statement provided by the defendant has to remain within the scope of the state laws whilst not violating the defendants’ rights.
The difference that brings itself out clearly is that while the judge has the ultimate determination of the admissibility of evidence in California, the other states, New York, Illinois, and Arizona the information is gathered on the basis under which the evidence was obtained before any ruling is arrived. These statements can be from defendants or even witnesses.
The most profound concept is that statements are only admissible if the defendants’ rights have not been violated and as given voluntarily. The defendants are charged with offences but this does not mean their right should be violated or treated any less human. They are entitled to their rights as all others are.

Mensa rea and actus reus

Throughout history, criminals are convicted using evidence of the crimes that they may have committed. Evidence is very important in criminal cases. Lack of evidence can make a case get dismissed. Normally, a prosecutor serves the public and is the state representative. He/she has to provide evidence to prove beyond any reasonable doubt that a crime was committed by the defendant. Such criminal cases include testimony from an eye witness, direct evidence, and indirect facts.
Evidence, in a criminal case has to bring out the Mensa rea and actus reus. The physical part of a crime which includes social harm, voluntary act, and causation is known as actus reus. If for instance the evidence provided proves that you inflicted injury to a child by stabbing it, then suffered a spasmodic attack then the attack was involuntary. Mensa rea is when your mental or internal status is not right, for example if you had a guilty mind.
The primary role of evidence is governing the proving facts in a legal proceeding.

Role Of The Family

ROLE OF THE FAMILY
The article states that, children with special needs tend to generate sensitive concern and stress in their families. Their families and parents encounter severe hardships in taking care for their children’s everyday needs and also coping with daily challenges that come with the roles bestowed upon them. According to the article, some roles which are paramount are provision of resources such as clothing, food, money and shelter for all members of the family and more so the children with the disabilities.
Providing nurturance and support is one of the primary roles that the article emphasizes on. This includes providing warmth, comfort and reassurance for members of the family. Physical, educational, emotional and social development of children solely depends on the life skills development role of the family for instance; helping a young adult in deciding on a career choice helping a child through school life academically, socially and spiritually.
According to the article, maintaining and managing the family unit is a role that has been neglected. This involves key decision making, leadership of the family unit, sorting out family finances and maintaining ties with the extended family, neighbors, and friends. Other key responsibilities of this role are enforcing and maintaining behavioral standards.

BENEFITS FACED BY FAMILIES OF CHILDREN WITH SPECIALTIES.

Having a disabled child in the family often poses tricky effects on the entire family. The situation brings in a feeling of unique shared experience among the family and may affect some aspects of family functionality. According to Dyson,(2010).There may seem not be any positive effects of having a disabled child, but there are a lot. It goes a long way in revealing the inner strength of family members. It’s also a key factor in encouraging conjoining of community and religious groups. Lastly, it enhances family cohesion.

CHALLENGES FACED BY FAMILIES WITH CHILDREN WITH SPECIAL NEEDS

However, in his explanation, Dyson, (2010) there are several negative effects, physical and emotional issues, time and financial demands and logistical complications that come along with the raising of the less fortunate child often has extensive effects. For parents, there is increased stress that can affect mental and physical health thus making it hard to provide appropriate child care. Reduced self-esteem, blame, and guilt may divert attention from other family functions. There also may be more financial costs from Medicare, and other services. These effects make the families make lifestyle adjustments and also affect the quality of a relationship. Finally allocation of family resources, attention, and time in the family structures change and can hurt the relationships of the family members.

OVERVIEW
In the article, a child who has special needs cause several effects to the immediate family. They make their parents have extra stress, feel guilty and even lose support from the society. However, these children also have positive effects. They include; teaches siblings respect for others and diversity.
The article also shows that many involved parents and families develop effective and positive methods to cope in daily life. The community can provide support to the needy families by having programs and also can cooperate with a supportive school to help out the children with the disabilities. A focus group should be designed to “put it all on the table” and let the involved families come together, share and forge a way forward. The article indicated that children with special needs have a wide range of both positive and negative effects in their families. Some of the negative effects are family stress, lack of support from the community and extended family members, hardships in learning in normal schools, different effects among siblings and parenting discrepancies (Dyson, 2010).
LESSONS LEARNT FROM THE ARTICLE.
Some of the positive effects that I learnt from the article were, while interacting with such children, one is able to learn to appreciate diversity in the society and also those who are immediate are able to learn to cope with the situation and even more hard ones.

EVALUATION OF CULTURAL BACKGROUND INFLUENCE.
In the article Learning Disabilities Quarterly, there are mixed approaches to the children with exceptionalities from their families. Some face hostility, rejection and even lack of appreciation as a human being by their own family whilst others really do get proper attention. Sometimes the community fails to give support to the families of the children with special needs and that even boils down to the kids and they can feel rejection isolation and even discrimination. The worst hit area is schools where they are supposed to learn with the others. Due to learning speed, special conditions diets, and therapies, they are mostly in the spotlight and many of them can’t handle it.

ECO-CULTURAL PERSPECTIVE.
Children with specialties should be accepted and treated with respect just like any other. Though we are a little different, the society should move away from the traditional thinking that disabled kids are a curse or even a source of bad omen Dyson,(2010).They should be treated with respect and we should strive to give them a comfortable life I all aspects. They should receive quality education, medical care, support from the society, schools and family and above all protection.

The world’s fastest growing and emerging markets are China and India. In the past decade, China had sustained a gross domestic product (GDP) growth rate of 9%. India on the other hand had 7% growth. The U.S had a slow growth while Europe had an Economic crisis. There has been a dramatic increase in population in many countries including the U.S. With the presence of many forces directly affecting marketing strategies, collectively known as macro and micro forces, the youth are now the dominant variables in the market. Products and services that are being produced now are youth-oriented.
With the technological advancement, there is definitely no wonder that times have changed a lot. Speed, quality, and convenience are the factors that today’s generation focuses on. Therefore marketers have to offer products and services that are of interest to the youth. The latest youth captivating niche is music, technology and fashion. Economic classes and more money spending are the constituents of the western style of consumption. Today, everything is superficial. The youth worry more in acquiring the latest smart phone, the trending fashion wear and flashiest car. Therefore today’s marketing strategies are in line if the ways easiest to attract costumers.
Currently Chinese market focuses on value and is willing to spend on goods that have quality and safety. Subsequently, the consumers are on the upscale shifting for premiums for items that posse’s desirable feature. These has changed the marketing strategy in the market where by value is the primary and crucial aspect as opposed to latter generations where price was the determining factor. This is also happening in India as well. This behavior is pushing companies to produce better new products.
The Chinese have changed a lot since their culture demands to have products of good quality for the best price. Being family oriented, they tend to look into the standards of a family group as opposed to the individual. The Chinese have changed in the recent past in their choices of brands through the acceptance of goods that deliver genuine enthusiasm of possessing better quality.
The Indian fraternity also has high value orientation degree and so is China. Luxury brands also now have to design a unique strategy in pricing so as to earn a foothold in India. Indians also have a high regard for family orientation. But this orientation also extends further to friends. Brands that communicate emotions and feelings do really well in the Indian market. The Indian market poses a challenge in incorporating marketing strategies from the west. Due to the exposure to the west, there has been an increase of awareness among the Indians. There is a noted increase in the consumer selectivity on the quality of products. Subsequently, this has led to seeking of better areas of merchandise. Also they choose a place where customer relations are upheld. The Indian market is sensitive to price and would rather buy value for money.
In India parents influence is substantial. In the case of valued products, a lot of consultation is done within the family. The Indian costumer is price sensitive thus; they tend to think that price is an indicator of quality. Indians love heroes so, online marketing, print media with celebrities and other strategies that involve a celebrity provide positive feelings towards the products. Since Indians have a high value for their money, while introducing a new product, offering freebies will get the attention of many. They are also eco-friendly aware so such products can easily way into the market.
I believe that, adapting to the social orientations of a society plays an important role in providing a clear marketing strategy for china and India. Also this is an indicator of openness to new products so long as the product is flexible and adaptable.

Joining the University is the chief time in the life of an individual whereby one can have new learning experiences which are more than just academics. It’s a time when one is able to know their true personality. Since college life is constituted by growing and developing, it’s evident that going to study abroad presents infinite opportunities and possibilities in line with fulfilling a student’s goals.
The chance to study abroad contributes positively to ones education, personal goals and even career. It is a great advantage in equipping students with the apparatus they need to raise their academic caliber and transform them into a better persons. Studying overseas will also increase the value of my Bachelors in Computer science degree. While I will be abroad, may gain a different academic perspective and interest in Computer Science. I shall be able to take courses in a multicultural environment which are not available here in Kenya. Since the world has become more globalized, employers are looking for employees with international experience and diverse skills, thus it will add more value to my degree, it will, therefore, enhance my future employment opportunities. Many large firms Such MIT and WAL-MART will help to enhance my portfolio. No matter what I opt to do with my experiences abroad, I am assured that there will be a plus to my professional and personal development hence it will make me a good Computer Scientist than I am.
As an African saying goes, “surround yourself with the people with the mission as yourself” I now want to be surrounded by people with the same goals as me of getting world-class education, and crystallizing it into something I am looking forward to. My ability to interact well with people from all walks of life and the fulfillment that comes with networking and helping people has made me who I am today.
First and foremost, students improve their language skills a lot while having their studies abroad. There’s no better teacher of a foreign language than the native speakers in a natural environment. Also learning programs also offer language lectures at the starters’ level and the advanced level. Students, also have the opportunity to expand their knowledge base about other cultures, ways of thinking, lifestyles and coping with different environment. Studying abroad opens up the student to thinking on a global level. Residing in another culture and knowing it is not just a learning experience, but also there is personal gain. The next priority is making new contacts and creating networks. Also, students create a huge network of friends apart from the host families and lecturers.
I have already chosen the United States of America for a reason. The reason is I would like to visit MIT which stands for Massachusetts Institute of Technology. It was formed in 1861 in due to the increasing industrialization in the United States of America. The institution provides the necessary technology and also has the capacity to provide the services I want in the Computer Science field.
I am scared of the immense potential in me that lies unexploited. I believe that with the right education, support and facilities will help me become a person who will change the swing of things in my neighborhood. I believe that the education and personal involvement in one of the world.
I am excited on going to study abroad and I am planning to gain a lot of experience from another culture. How the community works in comparison with here in Africa. Our lifestyle is very different from other countries in the world. The exposure gained from living in another culture, will teach me different traditional ways and norms of other people. Whilst I am doing my studies, I will also take in every new experience and learn that there more to life than what I was taught in Africa.
This is a lifetime chance. An opportunity presented and I won’t take chances. As a technology student, I want to make the best out of it. My participation in this program will build my professional profile and is going to get me a step closer to the accomplishment of my major goal; graduating. Having being in a global entity, it will boost my self-esteem and will help boost my professional goals like improving my communication skills, network creating ability, and leadership roles.

By and large, I feel that my persuasive speech wasn’t the best. I feel that I should have been more organized and prepared so as to deliver the best and be in a position to persuade the audience. Though I was able to get the attention of the audience I could not sustain it although the speech.
In the conclusion I brought in positive energy, I projected my voice and used gestures. I also summarized the whole speech into one sentence which has the whole importance and purpose of the whole speech.
Though not fully, I managed to persuade my listeners to concur with me. During the speech, I observed that they were nodding in agreement and at times they even clapped. This is a clear indication that they were in agreement. My motivational appeals were effective mostly the logos appeal. Giving numbers and facts went along way in giving my audience tangible comparison to the facts given. I also used information that is at the disposal of almost everyone in order to set the foundation of the speech.
The rational appeals also went a long way in persuading my audience. I employed an approach known as convincing proof to help persuade my listeners. I gave an illustration of great leaders who went studying abroad and ended up being very useful and important people in their respective societies. Also, I used the second approach which is listing the benefits of a product or service. After listing and briefly explaining the importance of studying abroad, I could see the audience nodding in agreement. This approach mainly highlighted the benefits of studying abroad by the society and the individual student.
I never had any foreign citation the speech, but I had a specific outcome for the audience. I wanted them to concur with me under whatever costs. By using situational manipulation, I limited their options to almost none and had them to only agree with me. If I had the chance to do the speech all over again, I wouldn’t change the purpose of the speech I would only do more intensive research on the topic and work more on my delivering techniques. In contrast to my other speeches, this one was average and more manipulative.
In this speech, it wasn’t very dynamic though I decide to use cause and effect since cause and effect speeches are easier to write. This is because they show how something positive or negative can happen if you do something. So long as I had enough creditable sources, I really never had to do a lot of persuading since the truth is in the pudding.
People are usually more receptacle to what the speaker has to say in this case me. And inherently tend to incline lean to the positive side of the cause and effect technique. I have improved on my delivery techniques in the course of the semester by preparing well before hand and employing more use of gestures and more rational and emotional appeals. Also, I have included all the three emotional appeals in my speech, ethos, pathos and logos so that I can be able to at least appeal to all types of audiences. I have also been over the stage fright. This problem is now long gone.
My main strengths in the speech were the proper employment and use of the rational, emotional and motivational appeals, some of my weaknesses were in the delivery and organization of the speech.
The main areas that need improvement are on delivery; I need to be more composed and impose credibility to the audience that I know whatever I am saying. Also, organization is another point of concern, beforehand preparation of the speech will help boost my composure. I also have plans in motion to work on my ordering criterion. The order will help in the nice flow of the speech. Researching on the content is what I also take will advantage of. Rigorous research and brainstorming will go a long way in content development.

Significance of evidence

Unit 3 Discussion
The significance of evidence should always be kept in the mind of the investigator in the course of crime scene investigation. The investigator should spend more time collecting evidence that can identify a suspect positively for example fingerprints and hair. Evidence preservation should be done in a manner that no alteration whatsoever should happen to evidence to preserve its integrity. Most evidence items can be collected in paper containers. Liquid evidence should be transported in leak-proof and non-breakable containers. Blood and plant evidence samples can be carried in plastic containers for a minimum of two hours. If kept for more than two hours, the evidence can be destroyed due to the growth of microorganisms ( Briody, 2002).
Throughout history, criminals are convicted using evidence of the crimes that they may have committed. Evidence is very important in criminal cases. Lack of evidence can make a case get dismissed. Normally, a prosecutor serves the public and is the state representative. He/she has to provide evidence to prove beyond any reasonable doubt that a crime was committed by the defendant. Such criminal cases include testimony from an eyewitness, direct evidence, and indirect facts.
Evidence, in a criminal case, has to bring out the Mensa rea and actus reus. The physical part of a crime which includes social harm, voluntary act, and causation is known as actus reus. If, for instance, the evidence provided proves that you inflicted injury to a child by stabbing it, then suffered a spasmodic attack then the attack was involuntary. Mensa rea is when your mental or internal status is not right, for example if you had a guilty mind.(Giannelli, 2009).
The primary role of evidence is governing the proving facts in a legal proceeding. Evidence also helps criminal investigators to reconstruct and connect the scenes of crime with the suspect.
Evidence preservation is the most important phase in evidence processing. When evidence is poorly or insecurely preserved chances of it been tampered with are high for instance; wet evidence sample can easily be damaged if not properly preserved. Different evidences are stored differently. Arson proof is usually preserved in clean and airtight metal cans. Only huge amounts of dry powder are supposed to be preserved in plastic bags. In all stages of evidence processing, all evidence should be secured and inventoried so as to help preserve its integrity. Admissibility of evidence in a court of law can be predicated in the event of a broken chain if evidence custody. Evidence at trial should be the same as that at the scene (Cowdery,2002)
Physical evidence is used to narrow the possibilities free of eyewitnesses. Since physical evidence does not have a bias, it exists independent of any party. This is the ultimate reason why physical evidence should be discovered, properly analyzed and not contaminate it. In the case of lack of enough evidence or mal-handling of evidence, can there be a “victimless” crime?
